1. DEFINITIONS
The Client:The recipient of the service and name listed on the booking form
The Artist: Ashley Kay
The Agreement: The contract that exists between the client and the makeup artist for the agreed fee
The fee: The amount payable by the client to the makeup artist for the services listed above
The event: Relates in principal to the date whereby the event the wedding takes place.
The party: Additional members of the bridal party
2. SECURING THE BOOKING OF THE EVENT
The booking of the event is only reserved once the client has paid the non-refundable booking fee to the makeup artist. If this payment is not made within 7 days of the invoice being sent your date may be released without notice.
Arranging a trial does not reserve the makeup artist’s services for the event.
One day prior to the commencement of the trial, the trial fee is due in full and must be made or the artist reserves the right to release the trial dates.
Events from April – November are subject to a 4 person minimum hair & makeup or 5 person minimum for hair OR makeup. Reducing bookings once they are confirmed will result in full payment due on original booking.
Ashley Kay Beauty provides hair and makeup services. By Making a form of payment to Ashley Kay Beauty for delivery of services, You, the client, agree to the Terms and Conditions listed below, without modification.
3. PAYMENT
Payments can be made in cash, Pay Pal, Square-up or via bank transfer, cheques will not be accepted.
The non-refundable booking fee, paid by the client is taken off the total fee.
The full trial balance must be paid for 1 day prior to the commencement of the trial.
If you were not happy at trial with your hair and/or makeup and choose not to go forward with your booking you will receive back the payments paid minus the cost of the trial & the non refundable booking fee.
The first 50% is to be paid by the client 3 days post trial, minus booking fee and trial fee.
The final 50% is due 14 days before the event.
Failure to pay the fees within the stated times will result in the event being released.
4. RESPONSIBILITY OF THE CLIENT
The client shall inform the makeup artist of any issues that may affect the use of any equipment or products. This includes but is not limited to sensitivities, allergies and medical conditions. The makeup artist cannot be held liable for any losses that are incurred due to the client’s failure to inform them of any know condition.
The artist reserves the right to refuse service to the client or members the party for, but not limited to, abusive and threatening behaviour.
Final numbers receiving the services at the Event must be received in writing from the Client to the makeup artist, at least two weeks before the Event. If numbers subsequently increase, the makeup artist reserves the right to increase their Price accordingly. If numbers subsequently decrease, there will be no discount and the Price shall be charged at full.
5. CANCELLATIONS
The artist has the right to turn down additional members if it is not feasible to complete the entire party in time.
The client at any point in writing can cancel the event up to 12 weeks before the event.
The makeup artist will be under no obligation to refund any money paid up until point of cancellation, however the client will not be liable for any further payments.
Within the 12 week period, leading up to the event, the client is responsible for paying the fees of the event, regardless of cancellation.
The client can cancel a trial at any point however a trial cancelled with less then 24 hours notice will be charged for at the agreed rate.
Cancellations by the artist due to circumstances including, but not limited to, problems rendering the artist's performance of their obligations where no other suitable alternative can be given a full refund will be given to the client. No further compensation will be offered.
If the booking is directly affected by circumstance beyond the control of the artist where possible the artist will endeavour to rectify such situations however no compensation will be offered on the artist part. It is strongly advised you take out wedding insurance to cover you against these situations.
Reductions to the bridal party will not be accepted once the contract is agreed.
6. EXCLUSIVITY
It is understood that the artist is the only authorised hair/makeup artist for the day. Other professional hair/makeup artists are not permitted, whether official or otherwise working for pay or otherwise (e.g. separately employed by parents, contracted by magazines or newspapers), unless agreed in writing before the day.
Breach of this condition shall be deemed cancellation of the contract by the Client.
7. PHOTOGRAPHY
The client agrees that the artist may use any photography for publicity purposes which include but are not limited to the artist's website and social media pages. By signing this contract the client is giving permission for photographs to be released to the artist by the photographer unless stated otherwise.
8. TRAVEL EXPENSES
The client will cover any necessary travel expenses of the makeup artist as agreed at time of booking this is to include should it be required congestion charging and parking charges.
9. Covid-19. POSTPONEMENT & CANCELLATION
Government enforced lockdowns, resulting in full cancellation of a booking and a booking fee has been paid to hold the date, this will be refunded by, Ashley Kay Beauty, minus admin fees, charged at £90p/hr.
Normal refund policy apples for cancellation of services, due to restrictions on wedding party numbers.
Any trials completed and paid for, which have taken place, regardless of postponement or cancellation, are non-refundable.
If a new trial is required at a later date, for the postponed wedding, standard trial fees apply.
Postponement, due to government lockdowns, will not incur additional booking fees to hold the new wedding date. The booking will be moved over to the new wedding day and a new contract will be signed with all fees carried over.
Postponement, due to wedding number restrictions, will require a new booking fee to hold the postponed date.
Postponement within the same year as the original booking will not incur a service price increase.
Postponement to a new year may be subject to price increases due to running costs and natural inflation.
Please note that as soon as you think you may postpone, contact all of your suppliers to ensure they are available for the new date.
Postponement to a new date where the makeup artist is unavailable will revert to the original contract cancellation policy.
COVID-19 HEALTH & SAFETY POLICY 2021
STEPS TAKEN TO MITIGATE RISK OF VIRUS TRANSMISSION
Ensure makeup artists, assistants and clients who feel unwell, stay at home and appointments can be rescheduled.
Beauty Treatments, Trials and consultations take place in my studio in Norwich. There is ventilation and sterilisation in place.
Gloves will be worn, along with apron and hair will be tied back for all beauty treatments.
Hands will be washed before and after each client, along with hand sanitiser and disinfectant spray will be used on all surfaces.
Clinical wipes will be used to clean surfaces between clients.
1 to 2 meter distancing will be followed where possible.
Makeup brushes, tools and makeup products are sterilised between each client and each event.
New, clean, makeup brushes, and disposable tools are used with each client to avoid cross contamination.
Makeup and Hair Artists will adhere to site Health & Safety Policies when on location.
Ashley Kay of Ashley Kay Beauty is fully vaccinated.
